1. Overview

This website, cletya.com (the "Site"), is operated by LUXA LIGHTING LLC, a limited liability company registered in New Mexico, United States, with its registered address at 500 4th St NW Suite 102 #2464, Albuquerque, NM 87102 ("Cletya", "we", "us"). By visiting the Site or purchasing from us, you agree to be bound by these Terms of Service ("Terms").

Please read these Terms carefully before accessing or using the Site. If you do not agree to all the Terms, you may not access the Site or use any of our services.

2. Eligibility

By using this Site, you represent that you are at least the age of majority in your state or country of residence, and that you have the legal capacity to enter into a binding contract.

3. Products

We sell indoor lighting fixtures, including pendant lights, chandeliers, wall lamps and table lamps. We make every effort to display the colors, dimensions and details of our products as accurately as possible. However, we cannot guarantee that your screen's display of any color will be accurate. All descriptions and prices are subject to change at any time without notice.

All products are intended for standard residential use. Installation of hardwired fixtures should be performed by a qualified electrician in accordance with local electrical codes. We are not responsible for damages resulting from improper installation.

4. Orders and Payment

By placing an order, you make an offer to purchase the products under these Terms. We reserve the right to accept or refuse any order for any reason, including errors in pricing or product information, suspected fraud, or stock unavailability. If we cancel an order after payment, you will receive a full refund.

Prices are displayed in US dollars unless stated otherwise and do not include applicable taxes and shipping costs, which are calculated at checkout. Payment is due at the time of order and is processed securely by our payment providers. We do not store your full payment card details.

You agree to provide current, complete and accurate purchase and account information for all orders placed on the Site.

5. Shipping and Delivery

Shipping methods, costs and estimated delivery times are described in our Shipping Policy, which forms part of these Terms. Delivery estimates are provided in good faith but are not guaranteed. Risk of loss passes to you upon delivery of the products to the carrier's final delivery address.

If your order arrives damaged, please contact us within 48 hours of delivery with photos of the damaged item and packaging so we can arrange a replacement or refund.

6. Returns and Refunds

Our return and refund conditions are described in our Refund Policy, which forms part of these Terms. In particular: eligible products may be returned within 30 days of delivery; made-to-order and customized products (modified cable or rod length, custom dimensions, colors or finishes) are final sale and cannot be returned, exchanged or refunded except in the case of a defect or non-conformity; and for oversized products (any dimension of 60 inches / 150 cm or more), return shipping for change-of-mind returns is at the customer's expense.

7. Intellectual Property

All content on this Site — including text, product photography, graphics, logos and design — is the property of LUXA LIGHTING LLC or its content suppliers and is protected by applicable copyright and trademark laws. You may not reproduce, duplicate, copy, sell or exploit any portion of the Site without our express written permission.

8. User Conduct

You agree not to use the Site for any unlawful purpose, to solicit others to perform unlawful acts, to infringe our or third parties' intellectual property rights, to transmit viruses or malicious code, or to interfere with the security of the Site. We reserve the right to terminate your use of the Site for violating any of the prohibited uses.

9. Accuracy of Information

Occasionally there may be information on our Site that contains typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions or availability. We reserve the right to correct any errors and to change or update information, or cancel orders if any information is inaccurate, at any time without prior notice, including after you have submitted your order.

10. Disclaimer of Warranties; Limitation of Liability

The Site and all products are provided "as is" and "as available" without any warranties of any kind, express or implied, except as expressly stated in these Terms or required by applicable law. To the fullest extent permitted by law, LUXA LIGHTING LLC shall not be liable for any indirect, incidental, punitive, special or consequential damages arising from your use of the Site or products. Our total liability for any claim shall not exceed the amount you paid for the product giving rise to the claim.

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so some of the above limitations may not apply to you. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

11. Indemnification

You agree to indemnify and hold harmless LUXA LIGHTING LLC and its members, officers and agents from any claim or demand, including reasonable attorneys' fees, arising out of your breach of these Terms or your violation of any law or the rights of a third party.

12. Governing Law and Disputes

These Terms and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the State of New Mexico, United States, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the state and federal courts located in New Mexico, except where prohibited by applicable consumer protection law.

We reserve the right to update, change or replace any part of these Terms at any time by posting updates on this page. Your continued use of the Site following the posting of any changes constitutes acceptance of those changes.
